RULES OF THE ELECTRONIC STORE “WWW.st-dalys.lt”
1. GENERAL PROVISIONS
1.1. Trade in the “www.st-dalys.lt” (hereinafter referred to as the Seller) online store (hereinafter referred to as the Store) is carried out in accordance with the “www.st-dalys.lt” rules for the purchase and sale of goods (hereinafter referred to as the Rules), which, after being approved by the Buyer (the rules come into force after confirming the order – by clicking “order”), are a legal document binding on the parties, which establishes the rights and obligations of the Buyer and the Seller, the conditions for purchasing and paying for goods, the procedure for delivering and returning goods, the liability of the parties and other provisions related to the purchase and sale of goods in the “www.st-dalys.lt” online store.
1.2. The Seller reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements established by legal acts, by notifying the online store about this. If you use the services provided by the online store after these terms and conditions have been changed, it is considered that you have agreed to the change in the terms and conditions. We will notify you of all changes to our privacy policy on our website and in other places where necessary.
2. PERSONAL DATA PROTECTION
2.1. Any information provided to the seller and related to personal data is considered confidential and will not be made public.
2.2. The Seller undertakes not to disclose the Customer’s personal data and information related to the order to any third parties, except in cases and in accordance with the procedure established by law, e.g. to courts operating in the Republic of Lithuania, bailiffs, law enforcement agencies, the State Tax Inspectorate and other third parties with a legitimate interest. Your contact information may be transferred to our partners providing delivery of goods or other services related to the proper fulfillment of your order.
3. BUYER’S OBLIGATIONS
3.1. The Buyer, having placed an order in the Online Store, must pay for the goods and accept them in accordance with the procedure established by these Rules of Purchase and Sale.
3.2. The Buyer is fully responsible for the actions performed while using the Online Store.
3.3. The Buyer is responsible for the accuracy, correctness, completeness of the data provided in the registration form, and for timely updating of the data in the event of changes. The Seller shall in no case be liable for any damage incurred by the Buyer and/or third parties if the Buyer provides inaccurate, incorrect, incomplete data in the registration form, or fails to immediately update changed personal data.
3.4. The Buyer, having noticed that he has incorrectly indicated the product in the order form, must immediately inform the Seller about this. If the Buyer notices the error before receiving the email confirming the shipment of the goods, the Buyer shall immediately notify the Seller about this.
3.5. The Buyer undertakes not to transfer his login details to third parties. If the Buyer loses his login details, he must immediately, but no later than within 1 day, inform the Seller about this.
3.6. When using the services of the Online Store, the Buyer undertakes to comply with these Terms of Sale and Purchase, other conditions clearly specified in the Online Store, and not to violate the legal acts of the Republic of Lithuania.
4. SELLER’S RIGHTS
4.1. If the Buyer attempts to undermine the stability and security of the Online Store or violates the obligations specified in paragraph 3 of the Purchase and Sale Rules, the Seller has the right to immediately and without warning restrict or suspend the Buyer’s ability to use the Online Store or cancel the Buyer’s orders.
4.2. The Seller has the right to temporarily or completely terminate the operations of the Online Store without prior notice to the Buyer.
4.3 The Seller reserves the right to change the prices, quantities, sizes or other information related to the Goods presented in the Store.
4.4. The Seller has the right to cancel the Buyer’s order without prior notice if the Buyer – a natural person, who has chosen the provided payment methods, does not pay for the goods within 3 (three) days.
4.5. The Seller has the right to inform the Buyer by e-mail about special promotions and news. The Buyer may unsubscribe from the newsletter at any time.
5. SELLER’S OBLIGATIONS
5.1. The Seller undertakes to respect the Buyer’s right to privacy regarding personal information belonging to him, specified in the registration form of the online shopping center, except for cases established by the laws of the Republic of Lithuania and the “Rules on Personal Data Protection”.
5.2. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him/her under the conditions specified in Clause 9 of the Rules.
5.3. If the Seller is unable to deliver the ordered goods to the Buyer due to important circumstances, he undertakes to inform and offer an analogous or as similar product as possible. If the Buyer refuses to accept an analogous or as similar product as possible, the Seller undertakes to refund the money paid to the Buyer within 7 (seventy) business days, if an advance payment was made.
6. BUYER REGISTRATION AND CONCLUSION OF A PURCHASE-SALE AGREEMENT
6.1. The Buyer can purchase goods by registering in the online store www.st-dalys.lt.
6.2. The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, having selected the purchased product(s), confirms to the Seller (by checking the box when purchasing the goods that you agree with the rules of “www.st-dalys.lt”) and confirms the order. The Buyer is informed about the correctly submitted and confirmed order by e-mail, which he indicated in the order form.
6.3. Each Purchase and Sale Agreement concluded between the Buyer and the Seller is registered and stored in the Online Store database. The Registered Buyer has the opportunity to view the purchase history by logging into the Online Store system.
7. PRICES OF GOODS, PAYMENT PROCEDURE AND TERMS
7.1. The prices of goods in the online store and in the formed order are indicated in euros including VAT (21%).
7.2. The Buyer pays for the goods in one of the ways described in the online store section: Information > Payment methods.
7.3. The prepared parcel is sent only upon receipt of payment.
8. DELIVERY OF GOODS
8.1. When ordering goods, the Buyer undertakes to indicate the place of delivery of the goods and a contact telephone number.
8.2. The Buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer must inform the Seller that another person will accept the goods and specify the contact details.
8.3. The Goods are delivered by the Seller’s partners UAB “Omniva” and “DPD Lietuva”.
8.4. The Seller undertakes to deliver the goods to the Buyer within the terms specified in the product descriptions. At the same time, the Buyer agrees that in exceptional cases, the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller’s control. In such a case, the Seller undertakes to immediately contact the Buyer and coordinate the delivery of the goods.
8.5. In all cases, the Seller is exempted from liability for violation of the delivery terms of the goods if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the control of the Buyer.
8.6. During the delivery of the goods, the Buyer must, together with the Seller’s authorized representative, check the condition of the shipment. After the Buyer signs the consignment note or other document of delivery and acceptance of the shipment, it is considered that the shipment has been transferred in proper condition. Having noticed that the packaging of the delivered shipment is damaged (crumpled, wet or otherwise externally damaged), the Buyer must mark this on the consignment note or other document of delivery and acceptance of the shipment and, in the presence of the Seller’s representative, draw up a consignment damage report. If the Buyer fails to perform these actions, the Seller is released from liability to the Buyer for damage to the goods, if such damage was caused by damage to the packaging, which the Buyer did not mark in accordance with the procedure established above.

9. GOODS QUALITY GUARANTEE, RETURN AND EXCHANGE
9.1. The properties of each product sold in the Online Store are indicated in the product description provided on the website www.st-dalys.lt. The manufacturers of the products are responsible for the information about the properties of the products (its accuracy), and the Seller is responsible only for the proper presentation (transfer) of this information to the Buyer, unless otherwise provided by law.
9.2. The Seller is not responsible for the fact that the color, shape or other parameters of the goods in the Online Store may not correspond to the actual size, shape and color of the goods due to the characteristics of the display used by the Buyer.
9.3. The Seller undertakes to replace defective or manufacturing defects in accordance with the procedure provided on the website of the “www.st-dalys.lt” e-store in the section: Information > Return of goods.

10. RESPONSIBILITY OF THE PARTIES
10.1. The Buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the consequences arising therefrom.
10.2. The Seller is exempted from any liability in cases where losses arise due to the Buyer not having read these Rules, despite the Seller’s recommendations and his obligations, although he was given such an opportunity.
10.3. If the Seller’s online store contains links to the websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information contained there or the activities carried out there, does not supervise or control those websites and does not represent those companies and individuals.
10.4. In the event of damage, the at-fault party shall compensate the other party for direct losses.
11. OTHER PROVISIONS
11.1. It is strictly prohibited to copy or otherwise distribute information and photos on “www.st-dalys.lt” without the written permission/consent of the store.
11.2. These rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.
11.3. The law of the Republic of Lithuania applies to relations arising on the basis of these rules.
11.4. All disagreements arising from the implementation of these rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
